The Montgomery County Council will meet on Tuesday, April 18 at 9 a.m. and the meeting will begin with two proclamation presentations. The first, presented by Council President Evan Glass, will recognize Earth Day. The second proclamation recognizing Holocaust Remembrance Day will be presented by Council Vice President Andrew Friedson, Councilmember Sidney Katz and Council President Glass.
The afternoon session will begin at 1:15 p.m. with a proclamation presentation recognizing Minority Health Month, led by Councilmember Laurie-Anne Sayles.
More detail on each agenda item is provided below.
The County Executive’s Recommended FY24 Capital Budget and Amendments to the FY23-28 Capital Improvements Program (CIP) were transmitted to the Council on January 18, 2023. The CIP covers long-term investments in facilities and infrastructure or capital projects.
At 9:35 a.m., the Council will hold two work sessions to review amendments to the FY23-28 CIP and committee recommendations for the following:
Review: The Council will review the Education and Culture (EC) Committee’s recommendations for Montgomery College’s FY24 Capital Budget and FY23-28 CIP which can be viewed on pages one and two of the staff report. In addition, the Council will consider non-recommended reductions to the FY23-28 CIP amendments.
Montgomery College’s Amended FY23-28 CIP request totals $419.3 million, which is an increase of $83.5 million over the six-year period. The Executive’s recommended Amended CIP is $345.3 million, which is an increase of $9.5 million over the approved level, but $74 million below the request from the college.
Montgomery County Public Schools
Review: The Council will review the EC Committee’s recommendations for the FY23-28 Amended CIP for Montgomery County Public Schools (MCPS), which can be viewed starting on page three of the Council staff report. The Board of Education’s FY23-28 amendment request totals $1.94 billion. This level of funding is $165.7 million or 9.3 percent more than the original approved FY23-28 CIP of $1.77 billion. The Executive’s recommendation assumed $1.87 billion in six-year expenditures, which is $104 million more than the approved CIP but $61.65 million less than the Board of Education’s request.
Bill 22-23, Transient Lodging Facilities –Short-Term Residential Rental
Introduction: The Council President, at the request of the County Executive, will introduce Bill 22-23, Transient Lodging - Short-Term Rental, in conjunction with Zoning Text Amendment (ZTA) 23-04 to amend the provisions for short-term residential rentals. Bill 22-23 will reassign enforcement responsibility to the Department of Housing and Community Affairs (DHCA); increase the maximum penalty; amend the application process; and clarify the processes for challenges, suspensions, revocations and appeals.
A public hearing will be held on June 13.
Zoning Text Amendment (ZTA) 23-04, Residential Uses - Short-Term Residential Rental
Introduction: The Council President, at the request of the County Executive, will introduce ZTA 23-04, Residential Uses - Short-Term Residential Rental, in conjunction with Bill 22-23 to amend the provisions for short-term residential rentals. ZTA 23-04 will require the dwelling unit to be the property owner’s primary residence, limit the number of overnight guests regardless of age, and remove language for owner-authorized agents.
A public hearing will be held on June 13.
Vote expected: The Council is expected to vote on a resolution to approve Planning Board Regulation 25-22, Administrative Procedures for Development Review. On Feb. 6, 2023, the Montgomery County Planning Board transmitted its draft amendments to the Administrative Procedures for Development Review. The Board unanimously voted to transmit the regulations on Sept. 29, 2022. The regulations were introduced by the Council on March 7, 2023.
Planning Board Regulation 25-22 would establish the administrative requirements related to the review and processing of development applications that are acted on by the Planning Board or planning director. The intent of the amendments is to correct and clarify language in the current version of the administrative procedures, as well as make additional changes and corrections. The Council has 60 days to approve or disapprove the regulations. Since the Council was not in session when the 60-day period ended, an extension was scheduled. The Planning, Housing and Parks (PHP) Committee recommends approval.
