On Thursday, July 13, starting at 2 p.m., the Montgomery County Department of Transportation (MCDOT) will hold a virtual public hearing on the proposed abandonment of a portion of public right of way along Frederick Road in Clarksburg. The public will have an opportunity to present oral or written testimony.
The property was previously acquired from the Potomac Edison Company in connection with the Frederick Road Bike Path project (CIP # 501118). However, the bike path's design was modified, resulting in a realignment of the bike path and drainage facilities across from the Potomac Edison property.
Because the Bike Path and Drainage Facility Easement Agreement provides for the use of the land for a public purpose, the land is within the public right of way. In order for the easement to be properly released back to the Potomac Edison Company, the right of way must first be abandoned. The property is located on the west side of Frederick Road (MD 355) opposite the Brink Road intersection, the areas to be abandoned include the following:
Abandonment of these easement areas will not affect the use or maintenance of the existing bike path.
Online registration is required by 5 p.m., Friday, July 7 to attend. On the morning of the hearing, an email with a Zoom link will be sent to registrants. Written testimony carries the same weight as oral testimony. Testimony and information provided will become a matter of public record.
