Move Over ! It's the law !

For Immediate Release: Thursday, April 5, 2012

MCPD wants to remind residents and commuters of the “Move Over Law”, enacted in October of 2010.   In Maryland, if you see an emergency vehicle on the shoulder of the road with its emergency lights flashing, you are required to move over one lane, if you can do that safely, or you must slow down to a reasonable and prudent speed.  It keeps everyone safe and it’s the law !

The fine for violating the "Move Over Law" is $110 and one point.  If the violation contributes to a traffic collision, the fine is $150 and three points.  If the violation contributes to a traffic collision resulting in death or serious injury, the fine escalates to $750 and three points.

Transportation Code 21-405 in summary:  Drivers approaching an emergency vehicle that is stopped, standing, or parked on a highway and using any visual signals must make a lane change into an available lane not immediately adjacent to the emergency vehicle, if possible with due regard for safety and traffic conditions, or slow to a reasonable and prudent speed that is safe for existing traffic conditions, unless otherwise directed by a police officer or traffic control device.
