Arrest Made in 2003 Rape

On March 3, 2003, at approximately 2:22 a.m., 3rd District officers responded to a call in the 800 block of Daleview Drive in Silver Spring; a resident reported a woman, partially dressed, knocking on the door asking for help.

The Major Crimes Division - Homicide/Sex Section investigated the incident.  Detectives determined that the victim, a 23-year-old Silver Spring woman, parked her vehicle in the 700 block of Lowander Lane at approximately 1:30 a.m. after returning home from work.  As the victim began to walk to her home, she observed a subject walking towards her.  As the victim passed the suspect, he pushed her to the ground.  The victim attempted to fight the suspect but the suspect choked the victim until she lost consciousness.  When the victim regained consciousness, the male was sexually assaulting the victim.  The suspect then carried the victim to the back seat of a vehicle and drove her to Montgomery Knolls Elementary School (807 Daleview Drive, Silver Spring).  The suspect then raped the victim.  The suspect fled the scene in the vehicle and the victim walked to a nearby home on Daleview Drive to seek help from residents and police.

Detectives were able to provide the public with a description of the suspect and asked for the public's help in identifying the suspect.  Information received from the public and investigative steps did not lead to a suspect.

In July of 2011, the Montgomery County Police Department received notice from the national DNA database that a DNA match had been made with evidence collected at the rape scene and DNA obtained from a prisoner in Texas.  The DNA match belonged to David Martinez, age 30, who was in the custody of Texas corrections.  There is no known relationship between the victim and suspect.

On June 14, 2012, Montgomery County detectives transported David Martinez back to Montgomery County to face charges of first degree rape, first degree sexual offense, first degree assault, and kidnapping.  Martinez is currently being held without bond and is awaiting trial.
