For Immediate Release: Wednesday, July 23, 2014

Detectives from the Montgomery County Police Major Crimes Division are continuing to investigate the officer-involved shooting that occurred on July 22, inside the Capital One Bank located at 8740 Arliss Street in Silver Spring.

Two officers responded to a trespassing call at the bank at 11:54 yesterday morning. The involved 3rd District officers are Michael Damskey with less than one year of service with the department and Marcus Lee with less than two years of service with the department. It has been confirmed that only one shot was fired and that it was fired by Officer Damskey.

The officers encountered an adult male suspect inside the bank acting erratically. The suspect was later identified as Donovan Bayton, age 54, from Silver Spring. Bayton failed to respond to officers' instructions and displayed a knife which threatened the safety of bank employees, citizens within the bank and the officers. A shot was fired after the officers' initial attempts to de-escalate the situation were unsuccessful.

The suspect was struck in the torso. He was transported to an area hospital where he succumbed to the injuries that he received from the shooting. During the investigation two knives were recovered at the scene.

As is standard procedure, the two involved 3rd District officers are on paid administrative leave pending the results of the investigation.
