Gaithersburg, MD - A Rockville man has been indicted by a Montgomery County grand jury on charges related to a fatal collision that occurred on Sunday, August 14, 2022.
The investigation revealed that 21-year-old Kevin Saul Orihuela was under the influence of alcohol and was driving a 2019 Audi A4 eastbound on Josiah Henson Parkway at a high rate of speed prior to the collision.
At approximately 4:12 p.m., Orihuela struck a 2014 Ford Fusion driven by 62-year-old Noel Henry Powell of Germantown. Powell was transported to an area hospital, where he was pronounced dead shortly after the collision.
The charges against Orihuela include grossly negligent manslaughter by vehicle, homicide under the influence of alcohol, homicide under the influence of alcohol per se, and homicide while impaired by alcohol.
Orihuela was indicted by the grand jury on Thursday, March 2 and arrested on Friday, March 3. An indictment is not a finding of guilt. Kevin Saul Orihuela is presumed innocent until proven guilty, pending the outcome of a trial.
