Bill 13-20 would require a disposition of a property that will be used primarily for
housing development to include 30 percent income-restricted housing units
ROCKVILLE, Md., March 11, 2020—Yesterday the Montgomery County Council introduced Bill 13-20, County Property – Disposition – Affordable Housing, which would require a disposition of a property that will be used primarily for housing development to include a certain number of moderately priced dwelling units (MPDUs). Councilmember Will Jawando is the lead sponsor. The goal of this legislation is to increase the availability of affordable housing in the County.
Bill 13-20 would require property dispositions that will be used primarily for housing development to include 30 percent income-restricted units. It also would exempt any disposition that will be used primarily for housing development from the declaration of no further need process if 15 percent of the units are MPDUs and 15 percent are for residents with an income of less than 50 percent of the area median income.
“A recent American Community Survey found that 49.5 percent of renters and 23.3 percent of homeowners in Montgomery County are housing burdened, meaning they spend 30 percent or more of their income for housing;” said Councilmember Jawando. “Bill 13-20 allows us to make the most of every disposition of county property that will be used primarily for housing development by setting baseline affordable and deeply affordable housing requirements. This represents one more attempt to increase our housing stock while ensuring that all Montgomery County residents have access to safe, clean and affordable living spaces.”
