The Montgomery County Council will introduce, hold a public hearing, and vote on the following Executive Order beginning at 11:00 am on Tuesday, August 4, 2020:
Introduction/Public Hearing/Action - Approval of Executive Order No. 87-20, COVID-19 Local Order – Amending and Restating Order dated June 19, 2020. On July 29, 2020, Governor Hogan issued State Executive Order 20-07-29-01, renewing the authority previously given Maryland counties to continue to impose more restrictive limitations on business and personal activities in order to prevent the spread of COVID-19. Some of the changes from prior Executive Orders include:
Food service establishments would be required to cease service of alcoholic beverages for on-premise consumption at 10:00 pm (except for carryout). Food service may continue after 10:00 pm.
The distinction between youth and adult sports would be removed. Only the play of low-risk and medium-risk youth and adult sports would continue to be permitted.
Religious facilities would continue to be permitted to open to the general public for indoor and outdoor services provided compliance with the following: one participant (or one household group) for every 200 sq. ft of religious ceremony space; and the number of outdoor service participants could not exceed 150 participants without a waiver.
Food courts located inside indoor malls would be limited to carry-out services only; dining at tables or other spaces in food courts must be removed. Malls would be required to remove tables, chairs, benches, or any other items which could encourage congregating from food courts and other indoor areas outside of retail stores.
The Montgomery County Council will meet as the Board of Health on Tuesday, August 4, 2020, to vote and adopt the following Board of Health Regulation:
Resolution to adopt the above mentioned Executive Order 87-20, COVID-19 Local Order, as a Board of Health Regulation. The Local Order is scheduled to take effect August 5, 2020, at 12:00 pm.

NOTE: During the Covid-19 state of emergency, the public is not able to be physically present in the Council Hearing Room. Once the public hearing sign up request form is submitted and the public hearing list is created, individuals will receive separate confirmation notifications that include the appropriate phone number to call for the public hearing.
Community members also have the option to provide audio, video and written testimony to the Council using a recently developed online testimony form on the Council's web page which can be found at https://www.montgomerycountymd.gov/COUNCIL/PHSignUp.html. The testimony provided with the online option carries the same weight as testimony given at a public hearing. Councilmembers consider all comments as part of their deliberations.
